The Union Minister of State for Social Justice and Empowerment, Pratima Bhowmik, has resigned as an MLA from the Dhanpur assembly constituency in the Sonamura subdivision. Bhowmik, who was elected from Dhanpur in the recent assembly elections, submitted her resignation to Shri Binay Bhushan Das. In an interview, she mentioned that as per the party's decision, she will continue as the Union Minister and resign as the MLA from Dhanpur Constituency.
Expressing her gratitude towards the people of Dhanpur and Tripura for their love and support, Pratima became emotional while submitting her resignation from the assembly. She also recounted her previous attempts to win the Dhanpur seat in the 1998 and 2018 assembly elections, where she had fought against former Chief Minister Manik Sarkar.
Assuring the people of Dhanpur, Pratima stated that she will always remain with them and serve to the best of her ability. It is important to note that Article 101 of the Indian Constitution prohibits a person from being a member of both Houses of Parliament (Lok Sabha and Rajya Sabha) simultaneously. Similarly, Article 190 prohibits a person from being a member of both the Legislative Assembly and the Legislative Council of a state at the same time.
Furthermore, Article 190(3) of the Indian Constitution allows a vacant seat in a state Legislative Assembly to be filled through a by-election, and it mandates that the vacancy must be filled within six months of its occurrence. The responsibility of conducting the by-election to fill the vacant seat lies with the Election Commission of India.
