Judicial Misconduct Scandal Rocks Tripura: High Court Takes Swift Action


In a recent development from Agartala, the Tripura High Court has taken decisive action in response to allegations against Bishwatosh Dhar, a first-class judicial magistrate stationed in Kamalpur, Dhalai district. Dhar stands accused of misconduct involving a rape survivor within his chambers last week. State law department officials have confirmed that the High Court has "closed" Magistrate Dhar, effectively instructing him not to leave his station without prior permission.

This decision comes in the wake of serious accusations made by a 23-year-old rape survivor, who reported inappropriate behavior by Dhar during her visit to his chambers to provide a statement under Section 164 of CrPC. Allegedly, Dhar's actions occurred subsequent to her harrowing experience of assault on February 13. The survivor recounted to authorities that Dhar made unwelcome advances, warning her of adverse consequences should she not comply. Fortunately, she managed to leave the chambers promptly without recording any statement

The gravity of the situation prompted the survivor's husband to file a complaint with the Kamalpur Bar Association, asserting that Dhar's actions amounted to molestation. Shockingly, Dhar allegedly defended his behavior by suggesting it was customary for judges to behave in such a manner during the recording of statements in rape cases. This revelation has sparked outrage, with many questioning the integrity of the judiciary and its ability to deliver justice.

Prompt action followed, with Kamalpur police registering a case on February 16 based on the allegations. Additionally, the survivor submitted an affidavit detailing her traumatic experience to the additional district and sessions judge. Registrar (vigilance) JM Murasingh personally visited the Kamalpur court to gather insights from staff, advocates, and judicial officers. Furthermore, a three-member team of judges, headed by Dhalai district and sessions judge Goutam Sarkar, has initiated a thorough inquiry. Their efforts include engaging with fellow judicial officers, lawyers, and court personnel to comprehensively evaluate Dhar's behavior and conduct.
